Foreclosure Mediation –Notice to the Bar
When suit is filed, counsel for the
plaintiff must file a completed Form A
with the Clerk of Court. If the property
is a homestead residence, all certifications in Form A must be filled out completely.

FORECLOSURE FINAL
JUDGMENT PACKAGE
Starting Monday November 9th, the
Clerk’s office will no longer accept and hold Foreclosure Final
Judgment Packages prior to the scheduled hearing date.
All proposed Foreclosure Final Judgment Packages shall be brought in
person to mortgage foreclosure hearings seeking a Final Judgment.
Please continue to mail pre-judgment documents (such as original
note & mortgage, affidavits, etc.) that need to be filed with the
Clerk’s office separately from the Foreclosure Final Judgment
Package.
Included in the Foreclosure Final Judgment Package, should be copies
to be sent concurrently to all parties/counsel of record with the
appropriate number of envelopes with the correct pre-paid postage
amount.
ELECTRONIC SALES FEE
Senate bill 2108 will require that starting July 1st, 2009, if a sale (real or personal property) is conducted by electronic means,
a service charge of $28.00 shall be paid by the winning bidder.

VALUE OF REAL PROPERTY OR MORTGAGE FORECLOSURE CLAIM FORM
Senate Bill 1718 will require that starting June 1, 2009 a party
instituting a civil action in circuit court relating to real property or
mortgage foreclosure shall pay a graduated filing fee based on the value
of the claim.
The VALUE OF REAL
PROPERTY OR MORTGAGE FORECLOSURE CLAIM form has been designed to assist
with the calculation requirements regarding mortgage foreclosure
graduated filing fees, based on the estimated value of the claim and
includes the required fees for mediation, education and additional
defendants.

On-line Tax deed and Foreclosure Sales are being held at the
clerk off the Court's on-line auction web site
www.charlotte.realforeclose.com. Prior to bidding on Tax
Deeds or foreclosures you must first register at the web site.
Notice of Foreclosure Sale Changes
Recent changes to Florida Statues have enabled Clerks of Court to hold foreclosure sales online.
Clerk of the Circuit Court Barbara T. Scott has selected Realauction.Com LLC
to process foreclosure sales online. Please be advised that any Foreclosure
Judgement submitted to the court setting a sale after January 1, 2009 shall
contain the following language:
The Clerk shall sell the property at public sale to the highest bidder for cash,
except as set forth hereinafter, on ________________, 2009 at 11:00 am at
www.charlotte.realforeclose.com in accordance with Chapter 45 Florida Statues.

Pursuant to Florida Supreme Court Amended
Administrative Order AOSC06-21 dated June 30, 2006, the Clerk of Court
is not permitted to electronically release any court record containing
the full birth date or address contained in that record.
Under Florida Law, e-mail addresses are
public records. If you do not want your e-mail address released in
response to a public-records request, do not send electronic mail to
this entity. Instead, contact this office by phone or in writing.
On or after October 1, 2002, any
person preparing or filing a document for recording in the Official
Record may not include a social security number in such document
unless required by law.
Any person has the right to request
the Clerk/County Recorder to redact/remove his or her social
security number from an image or copy of an Official Record that has
been placed on such Clerk's/County Recorder's publicly available
internet website.
The request must be legibly
written, signed, and delivered in person or by mail, to the
Clerk/County Recorder. The request must specify the
identification page number that contains the social security number.
No fee is charged for this service.
